Development Details: Kérkira Estate is a Sectional Title estate managed by the Body Corporate and Trustees who are appointed by the home owners.

The estate consists of four phases of which phases 1 & 2 are partly developed with 14 homes and 22 sites already sold. 

There are now 11 Real Right development sites available in this exclusive estate. Further sites in phases 3 & 4 are yet to be developed. 

ALL underground services including power, water, sewage, storm water etc. are in place for the available sites.

Sectional Title / Common Property: The Body Corporate has appointed a managing agent whose main function is to look after the financial affairs of the estate.

Home owners pay a monthly levy to the Body Corporate to cover the upkeep of the grounds and common property, general maintenance and wages of the security guards.

The levy is calculated proportionally to the area each home bears in relation to the total estate home area.

The purchase of a "Real Right" building site gives the buyer the right to build a home within an area demarcated by the surveyor's pegs.

On completion of the home and registration in the Deeds Office the pegs are removed and the unit is measured and registered on the Body Corporate Sectional Title Register.

Fences may not be erected around the Sectional Title units. All owners have an undivided share of the common property which includes the nature conservation area and facilities.  
 

The benefits of buying a "Real Right" within a Sectional Title Estate.

An increasingly popular sectional title option known as Real Rights, which effectively allows people buying into a sectional title development to build their own unit, offers a number of advantages for owners.

The Sectional Titles Act No. 95 of 1986 commenced  1 June 1988, and  with it came the innovative section 25, the section that deals with the developer's right to extend the scheme, and to do phase developments, without the necessity of having to retain at all times ownership for  himself of a unit in the scheme.

Thus a new type of development scheme became possible – the sale of a portion of the developer's right to extend to a purchaser (on which portion the purchaser could build) instead of the developer selling a unit built by him in a scheme.

Developers can therefore sell Units at a lower price as their holding costs on the development are reduced.

A Real Right gives the owner the rights to develop his piece of the sectional title scheme. 

The owner is therefore able to decide on the layout of the unit, the size of the unit, the style and finishes of the unit, within the parameters of the development.

The owner is thus directly involved in the building of his or her unit in what is effectively an owner-builder situation.

Once the purchaser (now a developer) has built his house, a land surveyor will prepare  a sectional plan of extension for him so that he can  register the plan in the Deeds Office.

Upon completion of the Unit, the owner of the Real Right will receive a Certificate of Registered Title, and his unit will be included in the Sectional Title Register together with all the other Units that have been completed and transferred.
